Sorry Deirdre, the info in brackets should read,

(However they’ve asked us repeatedly to do their dirty work, by getting the residents committee members to ask neighbours to pay their management fee)

Hi Deirdre,

I'm in a similar situation to Madeleine. Our developer is also in receivership/liquidation. I bought my apartment in 2006, developers are still the directors so apartment and house owners have little or no say in running of company and setting of annual fee. (However they've asked us repeatedly to do their dirty work, by asking neighbours to pay their management fee) The estate/development is finished and checking the CRO website, the management agent has been submitting accounts, reports, returns, etc, every year for our management company. We're hoping to get our county council to take over services, i.e. water, waste water and lighting. In order for this to take place the developer needs to submit a report on these services. We would ideally like the local council to take over the services before we take over directorship of our management company. I wouldn't like to see the developer off the hook, liquidation or no liquidation. I'm wondering if you could advise on best way forward. Will we end up paying for report on services to be completed before services are taken over? A small cross to bear in order that we can take over as directors. Any advice greatly received. Best wishes. Eoin.

Hello Madeleine,

The first thing I would do is find out who the directors are of the management company ? Info available from the CRO for a small fee.

I would also down load the last set of accounts and see what the management companies finances are like.

Is the developer one of the big guys who traditionally did not vest eg Zoe or Danninger ?

Let us know what you find out and we will try and assist with finding out the answer to you question above.

Hello,

I'm in the process of buying an apt and my solicior told me today that the developer never handed over the common areas to the management company. The developer is now in liquidation. This apartment block was completed in 1999.
Does the liquidator have the power to sign over the common areas to the management company? I'm nervous about going through with the sale now. What will it mean to me?
